Terms and Conditions of Sale

These terms and conditions apply to purchases made on wonky-nook.uk. By placing an order, you accept the terms in force at the time of purchase.

These terms do not limit the rights you have under mandatory consumer protection law.

1. Seller

The registered office address is administrative and is not a returns address.

2. Who can make a purchase

To make a purchase you must have the capacity to enter into a binding contract. Anyone under 18 needs the consent of a parent or guardian.

You are responsible for making sure the details you provide when ordering are correct and complete.

3. Products and product information

We do our best to describe and present our products as accurately as possible. Colours and details may look different depending on your screen, the lighting and your device's individual settings.

There may be slight variations that do not affect the main characteristics of the product. Product measurements are approximate, unless stated otherwise.

Availability and stock levels may vary. A product shown on the website is not guaranteed until the order has been accepted.

4. Prices

All prices are shown in pounds sterling (GBP) and include applicable taxes.

Free standard delivery within the United Kingdom is included in the price. Any optional extra services or special delivery services are shown and must be approved before payment.

We reserve the right to change prices in the future. A price change does not affect an order that has already been accepted.

5. Order and contract

By completing your order, you are making an offer to buy the selected products.

After you order, an automatic confirmation is normally sent to acknowledge that we have received it. A binding contract of sale is formed when we accept the order, for example by a separate confirmation, final approval of the payment or dispatch of the product.

We may refuse or cancel an order before delivery if:

  • the product is not available;
  • the payment cannot be approved;
  • the details provided are incomplete or clearly incorrect;
  • the order is considered fraudulent or abusive;
  • a price or other essential information is clearly wrong because of a technical or administrative error;
  • the delivery address is outside our delivery area.

If an order that has already been paid for is cancelled, we refund the corresponding amount.

6. Payment

The available payment methods are shown at checkout. Payment is processed by Shopify and its payment service providers in line with their security requirements and terms.

You are responsible for having the right to use the chosen payment method and for providing correct payment details.

We do not normally store full payment card details.

7. Promotions

Promotions are valid during the period stated and under the conditions shown in the shop. Discounts cannot be combined, unless expressly stated otherwise.

We may end a promotion or correct an obvious technical error. This does not affect orders already accepted, except where the price or discount was so clearly wrong that the customer should reasonably have realised it was a mistake.

8. Delivery

We currently deliver to the United Kingdom only.

We offer free, tracked and secure delivery with Royal Mail. An international logistics partner may handle part of the journey before the parcel is handed over to Royal Mail.

The current estimated delivery time is shown in the shop, at checkout, in the order confirmation or in later delivery information. If no specific time has been agreed, delivery takes place without undue delay and within a maximum of 30 days.

An order may be split into several deliveries at no extra delivery cost.

9. Risk during transport

We are responsible for the product until you, or a person nominated by you, have received it.

If you arrange your own courier that was not offered by us, the risk passes to you when the product is handed over to that courier, to the extent permitted by applicable law.

10. Cancellation

You have the right to contact us and ask for cancellation before the product has been delivered.

We will try to stop the order where possible. If processing or dispatch has already begun, the order may have to be delivered, after which you may exercise your right to cancel.

In some situations the seller may be entitled by law to compensation for the actual costs incurred because of the cancellation, in particular for a personalised product. This does not affect the statutory right to cancel where it applies.

11. Right to cancel and 30-day returns

You have a statutory right to cancel of at least 14 days for distance sales. Wonky Nook offers an overall 30-day right of return from the day you receive the product.

Contact support@wonky-nook.uk before the period ends and wait for the correct returns address and instructions. The customer generally pays the return costs when the return is due to cancellation, the item or colour chosen, or any other reason that is not our mistake.

12. Faulty products and complaints

Under the Consumer Rights Act 2015, products must be as described, fit for purpose and of satisfactory quality. You may reject a product that was faulty when delivered and receive a full refund within 30 days of delivery, and you may bring a claim for a fault present at delivery for up to six years (five years in Scotland). Please tell us about a fault within a reasonable time of discovering it.

Where a fault is accepted after the first 30 days, you are entitled first to a free repair or replacement, depending on what is possible and proportionate. A price reduction or a refund may apply where the fault cannot be put right within a reasonable time or where the law otherwise provides.

Your statutory rights are not limited by any commercial guarantee or by these terms.

13. Customer responsibilities

You agree to:

  • provide correct contact and delivery details;
  • check the order confirmation and report any errors promptly;
  • follow the care and use instructions for the product;
  • not use the website, promotions or payment systems in a fraudulent or unauthorised way.

We are not responsible for faults caused by fair wear and tear, accidents, misuse, inadequate maintenance or failure to follow the instructions.

14. Limitation of liability

We are responsible for direct and reasonably foreseeable loss or damage caused by our breach of the contract or of applicable law.

We are not responsible for indirect loss that was not reasonably foreseeable when the contract was made, or for loss resulting from the customer's own conduct.

Nothing in these terms limits any liability that cannot be limited by law, including liability for fraud, death or personal injury caused by negligence, or mandatory consumer rights.

15. Events outside our control

We are not responsible for delays caused by events outside our reasonable control, such as serious transport disruption, decisions by the authorities, natural events, war, conflict, epidemics, strikes, failures of critical infrastructure or similar events.

We will inform the customer and try to limit the consequences. If the delay becomes significant, the customer may be entitled to end the contract under applicable law.

16. Personal data

Personal data is processed in line with our privacy policy.

Payment and delivery data may be shared with Shopify, payment service providers, Royal Mail and other parties needed to fulfil the order.

17. Changes to these terms

We may change these terms in the future. The version in force when the order is accepted applies to the purchase.

18. Governing law and disputes

These terms are governed by the law of England and Wales. This choice of law does not limit the mandatory consumer protection rights you are entitled to.

If no agreement is reached, the dispute may be brought before the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts of your home nation.
